Michael Floyd was cut by the Arizona Cardinals after his arrest for driving under the influence in Scottsdale. According to authorities his blood alcohol level was .217 after he was found passed out behind the wheel of his SUV at an intersection. Shortly after his arrest, Floyd was claimed off waivers by the New England Patriots. The Patriots signed Floyd despite the harsh penalties that he could face as a result of this Arizona drunk driving charge. Arizona drunk driving laws are some of the toughest in the nation. Conviction of a 1st time driving under the influence charge with a blood alcohol level of .20 or higher can require 45 days in jail, fines of over $500 with multiple $1000 contributions to local funds and installation of an ignition interlock device.
A Scottsdale prosecutor spoke with ESPN regarding the charges. He stated that Arizona law requires jail time on the offense but the total amount of time is discretionary. He may be able to serve the balance of his time under house arrest with alcohol monitoring depending on the results of the case.
